Fresh off a publicized dispute with Brazil’s Supreme Court, Elon Musk has once again found himself at odds with another authoritative entity, this time in Australia. The renowned owner of X and staunch advocate for free speech is defiantly refusing to comply with an Australian order to remove videos of violence from his platform. This act of resistance has drawn the attention and criticism of the country’s Prime Minister, sparking a contentious clash at the intersection of free expression and government regulation.
Australia recently witnessed a distressing series of violent incidents, including the live-streamed stabbing of a bishop and a priest, which the government promptly categorized as an act of terrorism. The dissemination of graphic footage from the event across online platforms triggered public outrage and social unrest. In response, Australia’s eSafety Commissioner, Julie Inman Grant, invoked the powers vested in the country’s Online Safety Act, ordering social media giants X and Meta to expeditiously remove the disturbing content to prevent its further dissemination. The Commissioner’s urgency stemmed from the understanding that such material, once proliferated, inflicts profound emotional and psychological harm.
Meta swiftly complied with the directive, focusing on shielding users from exposure to the distressing content. However, X adopted a divergent stance. Asserting that the order exceeded the scope of Australian law and highlighting the absence of violation of its own standards on violent speech, X declined to globally remove the specified posts. The company emphasized that while it adhered to the directive within Australia pending a legal challenge, it categorically resisted the notion of global takedown orders as an infringement upon the principles of an open and unrestricted internet and an affront to free speech rights globally.
Prime Minister Anthony Albanese expressed incredulity at X’s resistance, dismissing it as an assertion of freedom of expression. Citing the exacerbation of societal divisions and the propagation of misinformation through unmoderated content, the Prime Minister underscored the social responsibility of platforms like X in restraining the dissemination of harmful material.
Elon Musk, known for his outspoken nature, took to X to express his opposition, sarcastically acknowledging the Prime Minister’s critique and decrying the impracticality of a single country attempting to assert dominance over global content.
The ongoing exchange has escalated with legal action, as the eSafety Commissioner sought an injunction against X, contending that the platform’s geoblocking measures were insufficient in limiting Australian access due to the potential circumvention through VPNs. The courts, responding to this development, issued a temporary injunction compelling X to globally conceal the contentious content pending further deliberation.
