Adidas, the renowned German apparel company, has recently filed a lawsuit against LIV Golf citing similarities in their respective logos. This unexpected legal battle has taken the golfing community by surprise, shedding light on the intricacies of trademark disputes in the industry.
Adidas Claims Similarities:
Adidas believes that the LIV Golf logo incorporates three stripes in a manner that bears a striking resemblance to their iconic trademark. The company argues that this similarity may cause confusion among consumers, potentially impacting the commercial reputation and identity of Adidas. This led Adidas to file a Notice of Opposition with the U.S. Patent and Trademark Office (USPTO) on September 18.
Chances of Success for Adidas:
Trademark attorney, Josh Gerben, expressed his opinion that Adidas faces a challenging battle in winning this case. He believes that while a settlement agreement is the most likely outcome, it would involve LIV Golf agreeing to certain limitations on how its ‘L’ logo may appear on products, thus minimizing the chances of confusing it with Adidas’ stripes. In essence, Gerben believes Adidas may struggle to completely prohibit the use of the contested logo by LIV Golf.
The Future of LIV Golf:
Beyond the ongoing legal dispute, uncertainties surrounding the future of LIV Golf persist due to an impending deal involving the PGA Tour, DP World Tour, and the Saudi Public Investment Fund (PIF) – the beneficiary of LIV Golf. Despite this, LIV Golf executives are currently planning a full schedule of golf events for 2024, spanning various destinations worldwide.
